The Commission is looking for lawyers and lay members of the public who are committed to providing legal services and who are sensitive to the needs of low-income communities. Lawyers and members of the public who have experience or familiarity with the particular problems of self-represented litigants, who have experience and familiarity with the economic development of the community, or who have knowledge of the structure and practice of banking and financial institutions are encouraged to apply. IntroductionA lawyer in private practice receives, holds and pays funds belonging to his clients and third parties on a daily basis in the course of representing clients. Millions of dollars pass through the hands of lawyers while serving clients, making managing client funds one of lawyers` most important fiduciary duties to their clients. To reduce the possibility of theft, embezzlement or misuse of client funds, the North Carolina State Bar Association has established fiduciary accounting standards in Rules 1.15 of the Code of Professional Conduct and has implemented a program of random verification of lawyers` trust accounts. This guide explains the requirements for separating, storing and recording client funds and how the random testing program works. The purpose of the manual is to answer questions about setting up an escrow account, depositing and withdrawing from an escrow account, keeping records for an escrow account, and what to expect if you are selected by the state examining attorney for the audit.
